New law art. 1: Changes in probationary period

Scope of Functions

The new law 25.250 art. 1 establishes new regulations for the probationary period:

• During the probationary period both employer and employee have to pay contributions and withholdings to Social Insurance.

• During the probationary period both parties can dissolve the work relationship without any obligation to express the reason nor adjust to no prenotice period. This dissolution does not generate any rights to severance pays.

In order to adapt the system to theses new regulations and to distinguish between the previous and the new situation, some changes have been made.

Effects on Customizing

1. A new contract type has been created for the new probationary period regulations. To see this, refer to the implementation guide in the following sections:

• Payroll Argentina -> Social Insurance -> Master data -> Assign legal contract types to contract classes, and

• Payroll Argentina -> Social Insurance -> Master data -> System tables check -> Check types of legal contracts.

1. New reduction percentages have been assigned to this new contract type. To see this, refer to the implementation guide in the section Payroll Argentina -> Social Insurance -> Master data -> System tables check -> Check percentage reduction per contract type.
2. The corresponding recruitment way has been assigned to the new contract type. To see this, refer to the implementation guide, section Payroll Argentina -> Lists -> SIJP: Integrated Retirement and Pension Scheme -> Check recruitment way assignment for contract type.
3. New rules for the calculation of severance pay have been created for this new contract type. To see this, refer to the implementation guide, section Payroll Argentina -> Severance pay -> General settings -> Define rules for severance pay calculation.
